This Privacy Policy describes how we collect, use, disclose, and safeguard personal information about you when providing services to you when you: (i) use our website or mobile services; (ii) visit or use our location at 1517 Mitchell Ave, Chattanooga, TN 37408 and its facilities and amenities as a member (“Member”) of our private membership social club (the “Club”) or as a non-member visitor; (iii) attend events at the Property; (iv) interact with us through email, SMS, telephone, social media, or other communication channels; or (v) otherwise engage with The Landing in any capacity (collectively, the “Services”).
This policy does not apply to information collected by:
· Us through any other means, including on any other website operated by us or any third party (including our affiliates and subsidiaries) that does not link to this policy; or
· Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through the Services.
We may provide additional or different privacy policies that are specific to certain features, services, or activities.

By interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this privacy policy. · Guest and Invitee Information: Personal information about your guests or invitees that you provide to us in connection with event reservations or Membership privileges.
· Communications: Messages, inquiries, feedback, and complaints you submit to us through the website, email, SMS, or directly to Property staff.
Some of the information identified above may be considered sensitive data under certain laws. If required under applicable law, we will collect and process sensitive Personal Information only with your consent. If you choose not to provide or allow us to collect some information, we may not be able to provide you with requested features, services, or information.

Opting out of promotional communications does not affect our right to send you transactional, billing, or Membership administration communications, which we may send regardless of your opt-out status.

· To enforce our Membership Agreement, Event Agreements, and other contracts with you.

· Insurers and Risk Managers: Insurance carriers and risk management providers in connection with claims, potential claims, or risk assessment
· Event Vendors: Photographers, videographers, AV providers, and other vendors engaged for specific events at the Property, to the extent necessary for event operations
· Collections and Legal Counsel: Third-party collection agencies or outside counsel engaged in connection with collection of overdue amounts owed to The Landing
We do not sell your Personal Information to unaffiliated third parties for their independent marketing purposes. We may use, share, or license aggregated or anonymized data —
which does not identify you individually — for reporting, benchmarking, and business analysis without restriction.
We may also disclose your Personal Information:
· To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
· To enforce or apply our terms of use and other agreements, including for billing and collection purposes.
· If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our organization, our members, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

12. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LANDING’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THIS PRIVACY POLICY OR THE COLLECTION, USE, OR DISCLOSURE OF PERSONAL INFORMATION SHALL NOT EXCEED THE THE TOTAL FEES PAID BY YOU TO THE LANDING IN THE
TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL THE LANDING BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM ANY PRIVACY-RELATED CLAIM, EVEN IF THE LANDING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13. Dispute Resolution Any dispute, claim, or controversy arising out of or relating to this Privacy Policy or The Landing’s collection, use, or disclosure of Personal Information shall be resolved exclusively through binding arbitration in accordance with the Governing Law; Dispute Resolution provision of the applicable Membership Agreement or Event Agreement between the parties, which is incorporated herein by reference, including the jury trial waiver and class action waiver set forth therein. Where no such agreement exists between the parties, disputes shall be governed by the laws of Tennessee, without regard to conflict-of-laws principles, and shall be resolved by binding JAMS arbitration before a single neutral arbitrator in Chattanooga, Tennessee, pursuant to JAMS’ Streamlined Arbitration Rules and Procedures. THE PARTIES WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT ALL CLAIMS SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS; CLASS ARBITRATION AND CLASS ACTIONS ARE NOT PERMITTED.
14. Information You Provide About Third Parties If you provide us with Personal Information about another individual — such as a guest, invitee, or co-host — you represent and warrant that you have obtained all necessary consents or otherwise have the legal authority to share that information with us, and that the individual is aware of and agrees to the practices described in this Privacy Policy. The Landing is not responsible for ensuring that such individuals have been informed of or consented to our collection and use of their information.
15. Photographs, Video, and Use of Likeness The Landing may photograph and video record events and activities at the Property for marketing, promotional, and social media purposes. By visiting the Property, you consent to The Landing’s use of photographs and video footage capturing your likeness for such purposes, without compensation to you. If you do not wish to be photographed or recorded, please notify The Landing staff prior to your visit. Withdrawal of consent does not apply retroactively to photographs or video already published or distributed by The Landing. The Landing grants you no rights in photographs or video taken by The Landing, which remain The Landing’s exclusive property.
